The crypto landscape continues to have Americans on edge. In a recent case, a federal court in the US ruled that certain emoji count as a form of investment advice.

This was reported by former SEC staffer Lisa Braganca. The court warned about using these emojis and the associated "legal consequences," the report said.

This finding comes from a class-action lawsuit against NFT developer Dapper Labs. Their "NBA Top Shot" NFTs could be viewed as securities (tradable rights and/or obligations that carry financial value), according to the Southern District of New York. In social media posts, investors are offered profits in the form of rocket (🚀), chart (📈), or money bag emojis (💰), which the court says should be viewed as a recommendation to invest.

What this ruling means for the rest of the crypto space remains to be seen. In the wake of the recent regulatory wave in the US, authorities (such as the SEC) are trying to classify cryptocurrencies as securities. This was recently the case in a lawsuit against Terra founder Do Kwon.
